After twenty years of negotiation within the framework of the Disarmament Conference, the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction was signed in Paris between 13 and 15 January 1993. At the same time, the signatory States adopted a resolution instituting a Preparatory Commission, established in The Hague, with the aim of `the prompt and effective establishment of the future Organization for the Prohibition of Chemical Weapons'. A variety of converging considerations led the Curatorium of the Academy of International Law to organize a workshop on this subject: first the very interesting nature of the highly sensitive problems raised by the destruction of chemical weapons, both on the strategic and political planes, as well as on technical, financial and ecological grounds; but also the originality and difficulty, from the legal standpoint, of the numerous questions which will inevitably arise in connection with the application of the Paris Convention. Finally, the Paris Convention, which is innovative in many respects, particularly in that it institutes international control over the whole of an industrial activity, may be used as a model in other areas of disarmament, in particular the area of nuclear weapons.

Review The Law of the Sea, the EU and Its Member States (Publications on Ocean Development, V. 28) / Springer:

The United Nations Convention on the Law of the Sea of 10 December 1982 entered into force on 16 November 1994. Since this date a single binding instrument has regulated the rights and duties of States at sea and regarding the sea. New concepts, such as the exclusive economic zone, archipelagic waters, transit passage through straits, and the International Seabed Area, are now fully recognized. The fifteen member States of the European Union are a significant sample for analyzing the practice of States, or at least that of the Western industrialized States, as regards the law of the sea. They include major and small maritime powers, coastal and land-locked States, States with coasts on the Atlantic Ocean and States with coasts on semi-enclosed seas such as the Baltic and the Mediterranean, States with and without involvement in deep seabed mining and States with different interests as regards fisheries. The fact that they all belong to the European Union is a very important common feature, which amply justifies the choice made to study them together. The book's aim is to give, through essays prepared by well-known specialists, a detailed survey of the attitudes and practice concerning the law of the sea of the member States of the European Union and of the European Community as such. The common positions of the member States and the results of their coordinated action also emerge from these essays. The fact that the member States and the European Community are now actively engaged in the process of becoming parties to the Law of the Sea Convention is certainly a major contribution to the consolidation of the Convention as a universal instrument, or at least as an instrument widely ratified by States of all continents and economic and political interests.

The aim is not simply to unearth and present, in a minimally edited form, the legal opinions of Fitzmaurice, but also to assess his impact within the Foreign Office. It concludes that the role of the individual international lawyer in government institutions is potentially very significant. However, his influence depends not simply on the stubbornness with which he holds onto his professional expertise, but also on his moral vision and sensitivity towards the complexities of the context in which he has the potential to shape events.

Review The New Chemical Weapons Convention--Implementation and Prospectus / Springer:

The Chemical Weapons Convention entered into force on 29 April 1997, and the major player, namely the United States, ratified it shortly before that date. This constitutes an important achievement in disarmament law and also a step forward in general international law, as the Convention, in order to solve a serious security problem, establishes an unprecedented regime for controlling relevant state and private behaviour, administered by a newly-created international organization. The system being both new and complex, there is a considerable need for interpretation and explanation. In order to make the Chemical Weapons Convention really work, additional measures of implementation are needed. These two problems are addressed by the various contributions presented in this book, which is the result of a common research project of three teams directed by the three editors. It reviews the history of the negotiations and then presents a thorough analysis of the major theatres of the Convention: the organization (OPCW), the verification regime, dispute settlement and reactions to non-compliance.
