Review UNHCR and Voluntary Repatriation of Regugees / Springer:Voluntary repatriation of refugees is generally considered to be the preferred, even ideal, solution to what is traditionally designated `the problem of refugees'. Its popularity may also be inferred from the fact that the United Nations High Commissioner for Refugees has declared the nineties to be the `decade of voluntary repatriation'. This study attempts to analyze the legal meaning of voluntary repatriation, its place within the framework of universal refugee law, and whether or not it deserves to be called an ideal solution. The focus is on UNHCR - the agency which is mandated to assist in the voluntary repatriation of refugees - as the constant and recurrent actor in the practice of organized large-scale repatriations. Review Legal Reform in Post-Communist Europe:The View from Within / Springer:This book represents an effort to assess the unprecedented political, economic, and social reforms that have swept through Central and Eastern Europe in the five years since the collapse of Communism. The dismantling of the Warsaw Pact, the Council for Mutual Economic Assistance, the Communist Party apparatus, and the various manifestations of the `nomenklatura' political control system have meant different things in different countries, but throughout the region we have witnessed a struggle to replace an authoritarian, one-party political system and a command economy with something resembling Western-style constitutional democracy and market economics. Accompanying this struggle have been attempts to transform the legal structure of these countries. It is no exaggeration to claim that lawyers, and particularly legal scholars, have played a central role in the struggle for reform in post-communist Europe. As conceived by its principal organizer and editor (Stanislaw Frankowski), this study gives these scholars an opportunity to express their perceptions of the success achieved to date and the work still remaining. A secondary goal is to expose a Western audience to the views and insights of legal scholars who have worked within the Central and Eastern European traditions. Review Sovereign (in)equality in International Organizations (Legal Aspects of International Organization) / Springer:This book challenges the dominant intellectual assumptions of mainstream international law scholarship regarding the principle of Sovereign Equality. The animus and scope of this challenge is situated in the context of the decision-making processes in International Governmental Organizations (IGOs) which employ the `one state, one vote' and/or the `weighted voting' rule. Using the theories of Functionalism and Legitimacy to analyze the legal implications and complications of the principal voting mechanisms and voting practices of certain key IGOs vis-a-vis the doctrine of Sovereign Equality, the author establishes that this doctrine has remained far too orthodox for contemporary realities. In this context, she emphasizes the importance of the necessity for functional legitimate decision-making processes in global governance, and, accordingly, advocates the elimination of the anachronistic and non-viable principle of Sovereign Equality from international institutional law. The author also rejects the introduction of any new principle in IGOs - e. g. democratic governance - which will render decision-making even less functional.
