Review The Moral Economy of Trade: Ethnicity and Developing Markets / Routledge:While trade and markets are of interest to social scientists, the question of what can be bought from where, from whom, and at what price, is a matter of concern for most members of any society. As the world market grows and becomes more homogenous and Western development agencies intervene, the construction of Third World market systems come under scrutiny. But how do changes in a market-system affect the lives of the traders, their customers and their country? This text investigates the agents of trade during the process of transformation from an indigenous rural subsistence economy into a cash-crop producing market, and a more or less integrated market-system in Southeast Asia. Drawing on earlier anthropological and sociological studies of trade and markets in tribal and peasant societies, the contributors look at this situation from the viewpoint of the individual trader or group of traders. They explore their action strategies and the dilemmas they face.

Review International Trade Law and the GATT/WTO Dispute Settlement System (Studies in Transnational Economic Law) / Kluwer Law International:This text is the result of an initiative by the International Trade Law Committee of the International Law Committee of the International Law Association to promote the progressive development of GATT/WTO law, and especially of its dispute settlement system, by making a comparative legal study of international and regional law and dispute settlement practice. Until recently there has been little discussion of the problems of GATT/WTO law and GATT dispute settlement practice. Part I of the book introduces the basic principles, procedures and historical evolution of the GATT/WTO dispute settlement system. It analyses the first experience and current legal problems with the new WTO dispute settlement system, such as the application of the Dispute Settlement Understanding to trade in services, intellectual property rights and restrictive business practices, the scope for "non-violation complaints", the standards of review, intervention by third parties, and the appellate review procedures and case-law. Part II examines the evolution of international trade law, and the application of the GATT/WTO dispute settlement procedures, in specific areas of international economic law, such as anti-dumping law, agricultural and textiles trade, restrictive business practices, trade-related environmental measures, the General Agreement on Trade in Services, the Agreement on Trade-Related Aspects of Intellectual Property Rights, and the Agreement on Government Procurement. Part III describes procedures for the settlement of international trade disputes in domestic courts and regional trade agreements, such as the EC, the South American Common Market and NAFTA and examines their interrelationships with the GATT/WTO dispute rules and procedures. The Annexes include tables of past GATT/TWO dispute settlement proceedings, as well as the texts of the WTO's Dispute Settlement Understanding and of the Working Procedures adopted by the Appellate Body of the WTO.

Review A Comparative Study of the Portuguese, British and Dutch Systems (Series on International Taxation) / Kluwer Law International:This work aims to explore the main distortions arising from the economic double taxation of distributed profits in three member states of the European Union: Portugal, the United Kingdom and the Netherlands. It presents a comparative analysis of the tax implications of this form of double taxation from a legal point of view. To this end, both domestic laws and international tax treaties are analyzed, inward and outward investment is covered and dividend income tax burdens are ascertained having regard to those taxes that directly influence the effective dividend income tax rate. The results of this analysis are assessed in light of the tax principles of neutrality, efficiency, nondiscrimination under EU law and the objectives of fair distribution of revenue between member states, simplicity and prevention of tax evasion. The author concludes that well-accepted tax principles, such as the principles of worldwide taxation and vertical equity, operate less efficiently within the overall tax system. Instead, the source principle is gaining momentum, with simplicity and neutrality aims prevailing over distributional criteria. From a theoretical point of view, therefore, the principle of capital import neutrality is of growing importance as compared with the principle of capital export neutrality. Furthermore, it is suggested that problems remain with regard to the balence between debt financing and equity financing, unless an exemption system is in place, further complicated by the more favourable treatment given to capital gains. Neither classical nor imputation systems, the author concludes, provide a satisfactory answer to these problems.
