Review The Multinational Enterprise and Legal Control:Host State Sovereignty in an Era of Economic Globalization / Springer:The author applies herself to the legal and pragmatic aspects of control surrounding MNE operations. The primary focus is on legal and administrative techniques and measures practised by host states to control - transparently or less so - foreign MNE activity within their territories, or even extraterritorially when effects are felt within national boundaries. The primary geographic focus is the six most investment-intensive industrialized states (namely, Canada, France, Germany, Japan, the US and the UK). At the same time an important message of the present study is precisely the implications for the developing countries as well as for the emerging market economies of central and eastern Europe - and even Asian nations besides Japan, because it is the sharing of this very "experience of years" that can best serve to facilitate a fuller participation on the part of the up-and-coming economies in the same global market place. Among the most important topics dealt with are discretionary legislation and other techniques (for instance, "creeping expropriation") of indirect control by the host state, outside of the recognizable investment-specific legislation; control through merger legislation and practice under national and supranational competition law and policy, and present prospects for an international antitrust/competition regime; jurisdictional issues, particularly in the competition/antitrust law arena, with an emphasis on the question of extraterritoriality and conflicts of jurisdiction, and the role of international comity; and the background and current environment for an international investment agreement. The ultimate objective is to provide a sound basis for assessing the elaboration of some form of international instrument or framework for the foreign direct investment operations of the multinational enterprise of the 21st century.

Review Annuaire Europeen 2000 (European Yearbook 2000) (Annuaire European/European Yearbook) (Annuaire European/European Yearbook) / Springer:The most significant international event of the year 2000 was, almost certainly, neither political nor military, but scientific - the announcement, in June, that the human genome had been almost totally decoded. Future generations may well see this as a major turning point, opening the way to radical changes in diagnosis, prognosis, and medical treatment. Often compared with the space programme, this vast enterprise still generates misgivings: this new power, which human beings now have, to modify the genetic heritage of living creatures raises fundamentally new ethical questions - and society as a whole will have to find the answers. In fact, the accelerating pace of scientific and technical progress seems to be reviving atavistic anxieties, some rational, others less so. Public-health crises, including the "mad cow disease" scare, which lasted into 2000, have fuelled these fears - the public's rejection of GMOs (Genetically Modified Organisms) tells its own story. As regards conflict, 2000 saw the Middle East peace process grind to a halt, and the Intifada resume. In Europe, the situation in Kosovo and Chechnya, both the scenes of fighting in 1999, stayed precarious. Peace and democracy did score some successes, however, particularly in Europe: the centre-left's victory in Croatia, sweeping former President Tudjman's party off the scene, the democratic party's triumph in Bosnia, and the fall of the Milosevic regime in Serbia.
