Review Annotated Leading Cases of International Criminal Tribunals: The International Criminal Tribunal for the Former Yugoslavia 1999-2000 / Intersentia:

The establishment of the international criminal Tribunal for the Former Yugoslavia and the international criminal Tribunal for Rwanda raised many new legal issues, such as the competence of the Security Council of the United Nations to establish a criminal tribunal, the relationship between the Tribunals and national authorities and the protection of vulnerable witnesses without violating the rights of the defence at the same time. In dealing with these and other issues, one has to bear in mind that there was no useful precedent to guide the International Tribunals in its work. Therefore, it was and is a major challenge to the Tribunals to come up with creative solutions to legal problems in a manner that enables the Tribunal to function effectively and that fully respects the rights of accused. The Tribunals' case law provides some of these solutions. The series Annotated Leading Cases of International Criminal Tribunals is useful for students, legal practitioners, judges and prosecutors who are interested in the various legal aspects of the law of the ICTY and the ICTR.

Review Increasing the Effectiveness of the International Court of Justice:Proceedings of the ICJ Unitar Colloquium to Celebrate the 50th Anniversary of the Court, ... Aspects of International Organization, 29) / Springer:

In April 1996 the ICJ/UNITAR Colloquium on Increasing the Effectiveness of the Court brought together judges, legal advisers, practitioners of international law and jurists. It provided an unprecedented opportunity for an in-depth and detailed exchange of views not only on the Court's performance to date, but also on its future role, as well as on possible ways and means of enhancing its operation; subjects discussed ranged from the Court's jurisprudence to its working methods, from assessment of its achievements to evaluation of its ability to handle issues arising from space exploration and the growing concern for the environment. This publication, which presents the papers delivered at the Colloquium and the discussions which took place around them, should constitute instructive reading for all who are concerned with the management and peaceful resolution of disputes.

Review Reproductive Freedom in the Context of International Human Rights and Humanitarian Law (International Studies in Human Rights) (International Studies in Human Rights) / Springer:

This is an investigation of reproductive freedom in the light of 1990s international law. The author discusses reproductive freedom in the context of feminist legal theory, international human rights and humanitarian law. She takes a holistic approach to legal abortion, medically assisted reproduction, surrogate motherhood, and forced pregnancy during armed conflicts. The author's aim is to advance debates about gender equality and reproductive rights, and to deepen the analysis of the legal concepts involved. In surveying the international commitment to women's rights and examining critically the way in which international global and regional human rights bodies and ad hoc international tribunals deal with issues pertaining to reproductive freedom and sexual violence, this volume makes clear to what extent contemporary international law norms may be used as a tool for change, and how they need to be adapted to meet the special needs of girls and women worldwide. Finally, the book explores what improvements are necessary to prevent and protect adolescents, women and men, against violation of their reproductive freedom.

Review Intellectual Property / Kluwer Law International:

The Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement), which concluded within the framework of the Uruguay Round of Multilateral Trade Negotiations, is one of the most far-reaching and comprehensive legal regimes ever concluded at the multilateral level in the area of intellectual property rights. It supplements and modifies the earlier conventions governing intellectual property rights, which were periodically revised to promote the quasi-uniform regulation of industrial property and copyright in a gradual and incremental manner. In comparison, the TRIPS Agreement constitutes a major qualitative leap which radically modifies not only the context in which intellectual property rights are considered internationally, but also their substantive content and the methods for enforcement of these rights and dispute settlement. In ten chapters, contributed by a distinguished panel of experts, this work offers a framework for understanding the background, principles and complex provisions of the TRIPS Agreement. It highlights the context in which it was elaborated and adopted, and the manner in which it is to be interpreted and applied.

Review International, Regional and National Environmental Law / Springer:

The sources of environmental law are multiple and complex. They are international, regional, transnational, national and local. They are legislative, regulatory, judicial, customary, and scholarly. They are voluntary and mandatory; and even when mandatory, they frequently involve novel strategies for obtaining compliance. And they engage practitioners, students and scholars with both the most challenging scientific problems and the most basic needs of survival. This text - which is simultaneously a treatise on international environmental law, a comparative study of American and European approaches to environmental legal issues, and a deliberate integration of the various "branches" of environmental law into a new synthesis more suited to current and emerging realities - represents a co-operative achievement of two groups, American and German, of outstanding scholars. This dual provenance reveals a contrast of reason and principle, authority and text, that opens the way to new and deeper legal responses to the exigencies of environmental concerns. In addition to in-depth descriptions of all the problems that beset our planet's air, soil, water, wildlife, polar regions, and atmosphere - and the protection of these environmental elements under international, regional, and national legal instruments - this book thoroughly examines the complex issues that lie at the heart of environmental law practice: liability, enforcement, compliance, due diligence, procedural obligations, performance standards, criminal sanctions, "debt-for-nature swaps", economic incentives and disincentives, reparation, dispute settlement, the powerful presence of the international trade regime, and many others. Some of the book's most revealing insights are to be found in its comparison of the authority and effectiveness of different approaches to common problems, such as the environmental laws and policies of Germany and the United States, and those contained in the European Union's environmental regime and the environmental side agreements to NAFTA. There is no other resource that combines the scope, currency, and comparative law value of this extraordinary work.
