In the Name of the People explores the profile of the perpetrators of Nazi genocide as reflected in postwar German trial sentences. It investigates their social background, their `route to crime', and their role in the Nazi extermination apparatus. In addition, it studies the postwar prosecution of these genocidal criminals in West Germany. It describes and analyses the obstacles, `bottlenecks', and omissions in the prosecuting policies and presents their statistical record. It examines the way in which postwar German courts dealt with these criminals by an in-depth study of the trial sentences against two specific groups of genocidal perpetrators: the `Euthanasia' and `Aktion Reinhard' killers. Review The Contested Maritime and Territorial Boundaries of Malaysia:An International Law Perspective (International Boundary Studies Series) / Springer:

This work is a detailed study of the origins of the maritime and territorial disputes of Malaysia. The reason why this Southeast Asian country has been chosen is because Malaysia provides a good example of boundary problems faced by most countries throughout the region. The author, who has lived for more than a decade in Malaysia and has a BA (Hons) in Anthropology, Southeast Asian Studies with Law and a PhD in International Law, first gives a detailed analysis of the country's overlapping maritime claims in the Straits of Malacca and Singapore, the Gulf of Thailand, the South China Sea, the Sulu Sea and the Celebes Sea, followed by a comprehensive examination of Malaysia's territorial disputes with Indonesia, Singapore, Brunei, the Philippines, China and Taiwan, including the complex question of ownership over the Spratly Islands. In assessing the present disputes, the historical context has been extensively detailed to demonstrate the longevity and complexity of the legal issues. The work scrutinizes the claims made under prevailing international law principles and examines the present level of dispute resolution. The main text is divided into two parts. The first examines the maritime claims arising from the publication of a map issued in 1979. The second analyzes five territorial disputes in which Malaysia is involved with its neighbours. The main issues throughout the work include the necessity to analyze the claims in their historical context and details in order to achieve delimitation results that will withstand the test of time even if political and economic circumstances change. This book examines laws and customs of war prohibiting rape crimes dating back thousands of years, even though gender-specific crimes, particularly sex crimes, have been prevalent in wartime for centuries. It surveys the historical treatment of women in wartime, and argues that all the various forms of gender-specific crimes must be prosecuted and punished. It reviews the Nuremberg and Tokyo War Crimes Tribunals from a gendered perspective, and discusses how crimes against women could have been prosecuted in these tribunals and suggests explanations as to why they were neglected. It addresses the status of women in domestic and international law during the past one hundred years, including the years preceding World War II and in the aftermath of this war, and in the years immediately preceding the Yugoslav conflict. The evolution of the status and participation of women in international human rights and international humanitarian law is analyzed, including the impact domestic law and practice has had on international law and practice. Finally, this book reviews gender-specific crimes in the Yugoslav conflict, and presents arguments as to how various gender-specific crimes (including rape, forced prostitution, forced impregnation, forced maternity, forced sterilization, genocidal rape, and sexual mutilation) can be, and why they must be, prosecuted under Articles 2-5 of the Yugoslav Statute (i. e. , as grave breaches of the Geneva Conventions, torture, violations of the laws of war, violations of the customs of war, genocide, and crimes against humanity). The author, a human rights attorney, academic, and activist, spent three years researching both the treatment of women during periods of armed conflict and humanitarian laws protecting women from war crimes.
