The radical changes taking place in the international scene during the late 1980s have presented the European Communities with important new challenges. The twelve member States agreed that the only way to respond effectively to this new situation was to speed up the European integration process, and in December 1990 two Intergovernmental Conferences were inaugurated, focusing respectively on the development of an Economic and Monetary Union and a Political Union. It was the difficult task of the Luxembourg and Dutch Presidencies to channel the often very diverging positions of the different actors in the process into the coherent set of amendments to the Treaties forming the European Communities. This publication examines the positions which the different Member States, the Commission and the European Parliament have been defending in the Intergovernmental Conference on Political Union and more particularly with regard to one of the most sensitive topics under discussion, namely the development of a Common Foreign and Security Policy (CFSP). The introduction places the debate on the development of a Political Union and a CFSP in an historical perspective and gives an overview of the progression of the negotiations. The concluding chapter presents a general framework for better understanding of the course and results of the negotiations, and a critical evaluation of the outcome. The annexes reproduce the main proposals on the development of a CFSP submitted to the Conference.

Review Liability and Environment:Private and Public Law Aspects of Civil Liability for Environmental Harm in an International Context / Springer:

"Liability and Environment" analyzes the role of law, in particular civil liability, in controlling environmental pollution and risk. In modern environmental policy, liability has become a popular instrument. In this book, Bergkamp takes a fresh look at civil liability for environmental harm in an international and transnational context. Over the last decade, industry's liability exposure for environmental harm has expanded significantly. At the international, EC, and national level proposals for onerous strict environmental liability regimes are pending. Applying an instrumental approach to legal instruments, the text aims to redefine the role of liability in the heavily-regulated environmental area. It shows that liability for environmental harm is not justified by the "polluter pays" principle, is an uncertain and unreliable instrument for achieving prevention, results in an inefficient insurance scheme, and plays a dubious role in adjusting activity levels. Based on an analysis of the basic characteristics of alternative legal instruments, Professor Bergkamp concludes that civil liability should play a more modest, limited role in an environmental law system dominated by public law. Where deterrence is not the objective, first party insurance, compensation funds, or other public law regimes should be preferred over liability rules. In addition to civil liability of private parties, Liability and Environment discusses State liability under international, EC, and national law. [+]
Under international law, breach of a primary obligation triggers a State's liability. Prof. Bergkamp argues that this rule should be applied also to liability of private parties. In the environmental area, a business' primary obligations are spelled out in detailed permit conditions, regulations, and statutes. According to Prof. Bergkamp, only if a primary obligation is breached, a private person should be liable for environmental harm. The system that Bergkamp advocates is an objective fault liability regime, in which public environmental law defines the standard of care for both government and industry. "In rebuilding our civil liability system, we should keep in mind that what is good for industry should be good for everyone (or it is not good for anyone), we should keep in mind that what is good for private parties should be good for the state (or it is not good for either). In rebuilding our civil liability system, the international law of State responsibility, which is unpolluted by risk spreading and activity level considerations, will guide us a long way. The enunciation of legal rules to protect the underwater cultural heritage is a complex issue, involving a matrix of interests and laws, both international and national. Two core issues are jurisdiction and ownership. The ownership question can be complex. The legal status of historic shipwrecks and their cargoes is a tangle of wreck, salvage and inheritance law, differing from one national legal system to another. There are no international policies on the ownership of cultural property, which is left open to domestic legislation. This volume focuses on both the general aspects of two of the most typical institutions introduced by the new Law of the Sea and the specific aspects related to the geographic and economic circumstances of Italy and Canada. It is divided into two parts. The first part deals with the delimitation of maritime boundaries, especially with respect to the continental shelf and the exclusive economic zone. The problem is approached from both a theoretical and a practical point of view, in particular, in analyzing not only the more well-known controversies in delimitation solved by international agreements or by international courts, but also still unsettled disputes in which Italy and Canada are involved. The second part deals with the legal regime of the continental shelf and the exclusive zone and the activities - in particular exploration and exploitation - carried out in them. The same approach as in Part One is used in juxtaposing Italian and Canadian views on relative regulation. The volume brings together the diverse legal experience of the two countries - Italy and Canada resulting from the different geographic, political and economic conditions found in each. It is enough to think that Italy is surrounded on three sides by a closed or semiclosed sea, the Mediterranean, while Canada borders on the Atlantic, Pacific and Arctic Oceans. The volume was financed by the Italian National Research Council (CNR).
