Review The Law of the Sea, the EU and Its Member States (Publications on Ocean Development, V. 28) (Publications on Ocean Development, V. 28) / Springer:The United Nations Convention on the Law of the Sea of 10 December 1982 entered into force on 16 November 1994. Since this date a single binding instrument has regulated the rights and duties of States at sea and regarding the sea. New concepts, such as the exclusive economic zone, archipelagic waters, transit passage through straits, and the International Seabed Area, are now fully recognized. The fifteen member States of the European Union are a significant sample for analyzing the practice of States, or at least that of the Western industrialized States, as regards the law of the sea. They include major and small maritime powers, coastal and land-locked States, States with coasts on the Atlantic Ocean and States with coasts on semi-enclosed seas such as the Baltic and the Mediterranean, States with and without involvement in deep seabed mining and States with different interests as regards fisheries. The fact that they all belong to the European Union is a very important common feature, which amply justifies the choice made to study them together. The book's aim is to give, through essays prepared by well-known specialists, a detailed survey of the attitudes and practice concerning the law of the sea of the member States of the European Union and of the European Community as such. The common positions of the member States and the results of their coordinated action also emerge from these essays. The fact that the member States and the European Community are now actively engaged in the process of becoming parties to the Law of the Sea Convention is certainly a major contribution to the consolidation of the Convention as a universal instrument, or at least as an instrumentwidely ratified by States of all continents and economic and political interests.

Review The Dynamics of International Law in Conflict Resolution / Springer:This work approaches international law as more than merely information contained in international legal norms, and does not view international law as a body of objective and binding normative commands. As "legal knowledge", international law encompasses rules, practices and the expectations actors derive through legal reasoning from conventional legal rules, customary norms, international adjudication, and international legal theory. The study is in three parts. Part 1 constructs a framework to analyze the effectiveness of international law to influence decision-making within conflict resolution processes. Drawing on the contending approaches of the New Haven School of International Law and its rivals and applying various devices of linkage theory, the analysis isolates variables and indicators of the impact of legal expectations on actors' perceptions about the normative contents of such rules in a particular bargaining process. Parts II and III apply the framework of Part I to explain the role of international law in the Central American peace negotiations of the 1980s. Using the framework, Parts II and III identify sources of uncertainty and diverging expectations in the Western Hemisphere that aggravated rather than assuaged in Central American crisis. Parts II and III also explain the normative constraints that affected Central American decision-makers and provided the basis for most of the regional consensus within the Esquipulas meeting. With the help of heuristic devices from the behavioural sciences, this study of international law proposes an alternative to the traditional views of international legal effectiveness in the modern world.
