Review A Systematic Guide to the Case-law of the European Court of Human Rights, 1997 - 1998 (Systematic Guide to the Case Law of the European Court of Human ... the European Court of Human Rights, Vol 4) / Springer:

This volume supplements the current (in 2000) three volumes of "A Systematic Guide to the Case-Law of the European Court of Human Rights". It covers the years 1997 and 1998, and follows the same system as the previous volumes. Thus this volume, together with Volumes I, II and III, offers a compilation of relevant passages of all the Court's judgments from 1960 up to and including 1998, arranged according to the Articles of the Convention and its Protocols. The guide should enable its users to find all the rulings of the Court which may be relevant to a given problem, and reduce considerably the time and effort needed for research. It will continue to be updated at regular intervals.

Review Regulation Public Procurement - National and International Perspectives / Kluwer Law International:

Because of its enormous economic power and susceptibility to corruption, public procurement - the purchase by government of goods and services - has come under increasing regulation as world trade expands. Three international leaders in public procurement law fully explain how the procurement award process must be managed to achieve its goals in global market economy. This work should educate government officials, trade lawyers, and students in how to comply with existing and emerging regulatory schemes as they: select a contractor and plan the contract, with detailed attention to terms, conditions and specifications; allow for national security, national industrial development, and environmental protection; get value for money and avoid waste of public funds; publicize contracts; combat corruption; secure successful completion of contracts; balance pressures to buy from domestic sources with the economic benefits of international competition; harness procurement power to promote social and environmental goals; enforce compliance with public procurement rules; and recognize circumstances under which discretion-based (rather than rules-based) initiatives may be more effective.

Review EC Securities Regulation (Oxford European Union Law Library) / Oxford University Press, USA:

In the wake of radical and far-reaching legal, market, and institutional reforms which followed the completion of the Financial Services Action Plan, the EC regime for Securities Regulation now governs Community financial markets and has almost replaced national law in this area. This long-awaited second edition considers the extensive new regime in its legal, institutional, political, and market context and assesses the forces which have shaped it. Far-reaching reforms have followed from the coincidence of law-making reform under the Lamfalussy process with the regulatory reforms adopted under the Financial Services Action Plan. This book considers key measures, including the 2003 Prospectus Directive, the 2003 Market Abuse Directive, the 2004 Transparency Directive, the reforms to the UCITS regime, the groundbreaking 2004 Markets in Financial Instruments Directive, and the extensive developments in clearing and settlement. A new chapter addresses the treatment of gatekeepers. Detailed attention is given throughout the book to the extensive rules which apply at level 2 and to the level 3 process. New chapters have also been added on law-making and supervision, following the dramatic developments which followed the establishment of the Committee of European Securities Regulators. The influence wielded by the CESR on EC securities regulation is a key undercutting theme of the book.

Review Commentary (1986-1992 : Commentary) / Springer:

The most ambitious round of multilateral trade negotiations since the formation of the GATT was formally launched in Punta del Este, Uruguay in 1986. With more than 100 nations participating in the "Uruguay Round" negotiations, complex economic problems and difficult political realities made reaching international accord on major trading issues a long and arduous process. The three-volume set presents a history of these negotiations, portraying how participating nations reached their current positions on the proposed major changes in trade in agriculture and textiles, adoption of rules for trade in services, review of existing trade regulations, increased protection of intellectual property rights and the liberalization of the market for many important products. The set contains information which should be useful for all involved in international trade. Legal practitioners, business executives, academics and government officials seeking to understand the position of the important players and grasp the implications of the final agreement should find this factually-objective and politically-neutral account of the negotiations a useful resource. This is volume 2 of the set. The complete set is also available, as are individual chapters, allowing for the purchase of only that information in which a customer has a specific interest.

Review A Thematic Guide to Documents on Health and Human Rights:Global and Regional Standards Adopted by Intergovernmental Organizations, International Non-Governmental ... Institute Human Rights Guides, V. 2) / Springer:

This publication is the second volume of "Thematic Human Rights Guides" published under the auspices of the Raoul Wallenberg Institute of Human Rights and Humanitarian Law. The aim of the Guides, as the title implies, is to facilitate the use of international human rights standards by their systematic presentation. Rather than reproducing full texts of various instruments, substantive standards are grouped according to subject-matter in order to enable users to quickly and easily locate the topic they may be looking for. A detailed index, with references to the many international instruments which address the same issue, reinforces this thematic approach. The choice of human rights and health for the second volume in this series highlights the aim of the Guides: to map out the entire range of human rights and fundamental freedoms as they relate to a specific topic. The size of this volume illustrates the number and variety of human rights standards relevant for health. Many of these standards have been generated by organizations dealing with health rather than human rights, and quite a few are found under medical ethics rather than human rights. Subsuming medical ethics under international human rights law is a novel development, pioneered by the Council of Europe. Elsewhere, the two fields remain separate and the publication of this Guide is intended to overcome this separation. Documents have been included which provide an understanding of human rights within the health profession (such as guidance to medical doctors with regard to abortion adopted by the International Medical Association) and those human rights safeguards that have been elaborated to prevent abuses by health professionals (such as those concerning mental health). [+]
All of these standards provide a substantive background for inter-professional dialogue on the evolving understanding of human rights. The book reflects the full range of issues encompassed by human rights and health. Besides the right to health, a wide range of rights and freedoms can be - and is - affected by the health sector. Priority has been accorded to the crucial human rights safeguards, namely those specifying protection against undue limitations or restrictions upon human rights. Much as with any other human rights topic, those safeguards are best developed for categories that are most vulnerable to denials and violations of their rights. Detainees, prisoners, victims of armed conflicts, children and the mentally ill thus figure prominently.

Review Diplomacy on the Jordan: International Conflict and Negotiated Resolution (Natural Resource Management and Policy) / Springer:

The Jordan River waters are essential for the development and well being of the people of its basin. Plans for the development of its water resources were considered since the beginning of the twentieth century, and have long been central to dispute between riparian nations. This volume reviews the roots of conflict over the Jordan between Arabs and Jews and the development of that conflict over the past 150 years. It analyzes the positions of Arabs and Israelis and the role of the United States in promoting a settlement. The work then presents the development of a negotiated resolution of that part of the conflict related to Jordan and Israel through the Middle East Peace Process. This book approaches the Jordanian-Israeli water affairs in the Jordan River Basin with a wide interdisciplinary perspective. It unfolds the full history of the dispute and negotiation process, beginning in the 1950s and ending with the water accord in 1974.

Review The New World Order and the Security Council:Testing the Legality of Its Acts / Springer:

The question of the judicial review of the acts of the Security Council is one of the most urgent and revealing contemporary issues facing the United Nations. Does the Security Council, acting with the unanimous support of its permanent members, have unlimited powers? Where do its prerogatives end? Is the Security Council alone entitled to decide where its powers begin and end? Are the actions of the Security Council exempt from any control? Judge Bedjaoui's intimate knowledge of the International Court of Justice enables him to approach the issue of the legality of Security Council actions from the perspective of a jurist. His book is both a work on positive law and an essay on normative law.

Review Encyclopedia of Genocide and Crimes Against Humanity - 3 Volume Set (T-Z-Index) / MacMillan Library Reference:

Genocide has been with us since the beginning of history and is a key element in the study of world history at nearly every level. The most widely studied and catastrophic examples are, however, historically close to the present day: the Nazi Holocaust, "ethnic cleansing" in Bosnia, tribal warfare in Rwanda and more. The Encyclopedia spans the globe to explain the issues behind crimes against humanity and human rights issues as they relate to individual countries and the world at large. It traces the history of events that qualify as genocide and crimes against humanity, profiles perpetrators and heroes, and explains international laws and law proceedings aimed at ending these practices. It also delves into depictions and manifestations of the phenomenon, such as propaganda, sociological and philosophical explanations, literature and film.
