Anti-dumping measures are a means of protection against a form of unfair trade practices, namely, selling goods to the Community at less than their true value. Consequently, EC's anti-dumping regulation (Regulation 384/96) potentially affects almost any class of manufactured goods and has wide reaching implications for companies selling or buying goods within the EC. When dumping does take place, the economic impact of dumping on Community industry and the impact of any anti-dumping measures subsequently adopted against the exporters found to be dumping, may well be as significant as that resulting from a competition investigation. The fact that the Montego Bay Convention has been only ratified by 37 States at present and that it will be some time before the 60 ratifications required by Article 308 are achieved has not prevented states from acting in accordance with the rules drawn up by the Conference. Close on one hundred states have established either exclusive economic zones broadly modelled on Part V or 200-nautical-mile fishery zones and drawn on the principles laid down for exploiting living resources. Although these laws have been formulated unilaterally by states, international custom, since the judgement by the International Court of Justice in the Fisheries Case of 18 December 1951, is derived from concordant national rules. This shift began even before the Conference ended, and has been consolidated since then. Moreover, the rigime governing the sea-bed beyond the limits of national jurisdiction defined by Part XI, which was the stumbling block of the Conference, is subject to transitional arrangements on the basis of two resolutions adopted in the Conference's Final Act, one providing for the establishment of a Preparatory Commission and the other on the preliminary activities of pioneer investors. This two-volume work, an earlier edition of which appeared in French, has been written by a team of experts of international renown. It presents an analysis of the Convention with an additional Chapter on the legal rigime governing underwater archaeological and historical objects.

It is a real challenge to deal with the subject of economic sanctions, a topic where law meets politics, while touching upon almost all areas of the law: public international law, private international law, even private law and public law, not to mention the "internal" law of certain international organizations particularly active in the field, especially the EC/EU. Sometimes considered as a "punitive" and "brutal" instrument, economic sanctions - even when adopted by a universal institution - have often proven to be ineffective. While the issue of the effectiveness of sanctions, as such, goes indeed beyond legal considerations, it would be fallacious to think that lawyers should confine themselves to an abstract analysis of the phenomenon or that legal tools would have practically no effect on the shape of the measures to be taken. On the contrary, law is at the core of the very concept of sanctions, and it is through legal tools that sanctions may be tailored to the ends to be pursued, reinforcing, by so doing, the effectiveness of the international legal system. In light of the current developments under way - which concern both institutional sanctions and decentralized countermeasures, as well as the often inextricable intertwining between these two levels - the judicious choice made by the Curatorium of the Academy was propitious for taking a fresh look at the issue of unity and diversity of sanctions under international law.
