Review Towards World Constitutionalism / Brill Academic Publishers:The world in which we find ourselves today is no longer governable entirely by resort to the classical system of international law. Even more seriously, it would seem that the purposes and principles of the United Nations Charter are no longer being served sufficiently in light of new concerns. The text adopted in 1945 does not convey the image of a world tormented by terrorists. Nor does it reflect the most pressing commitments of our time: to democratic governance, to environmental responsibility, and to a freer and more equitable system of world trade. Increasingly, the international law community acknowledges the need to set new priorities in the development of international law. To that end it seems timely to reconsider the case for strengthening the constitutional framework of norms and institutions that seemed to offer the promise of fulfillment in the second half of the 20th century. The post-Cold War euphoria of the 1990s has virtually evaporated under the stress of new concerns at a time when states comprising the UN system are no longer capable of addressing these challenges. Towards World Constitutionalism argues the case for a more ‘constitutionalized’ system of international law and diplomacy. It is published at a time that the call for reform of the United Nations has become more insistent than at any time in its 60-year history. Even those most faithful to the purposes and principles enunciated in the Charter have had to admit to concerns about the management of certain sectors of the organization; and most concede the unrepresentative character of the powerful Security Council granted legal supremacy as the enforcer of international peace and security. [+]
Many go further and complain of unconscionable political bias in the General Assembly and in certain, over politicized, agencies. This collection of essays, by a selection of distinguished scholars representing various traditions of international law, constitutes a major contribution to this debate. It is an important resource for scholars and practitioners, and for all those concerned with the future of international law, and the world community.

Review Unrepresented Nations and Peoples Organization Yearbook 1995 (Unrepresented Nations and Peoples Organization Yearbook) (Unrepresented Nations and Peoples Organization Yearbook) / Springer:Published for the first time, the "UNPO Yearbook" provides extensive information about the nations, peoples and minorities who are members of the Unrepresented Nations and Peoples Organization (UNPO). The UNPO was founded in 1991 to provide a platform for those peoples and minorities who could not otherwise address the international community in its main assemblies such as the United Nations. The mission of UNPO is to assist these peoples to advance their interests effectively through non-violent means, including diplomacy, use of the United Nations and other international procedures for the protection of human rights, developing public opinion and other action-oriented strategies, and exploring legal options to defend their rights. The "Yearbook" gives a detailed overview of the 1995 activities of UNPO, a review of the position of UNPO members and supporting members, a selection of key documents and the 1995 mission reports. The "UNPO" "Yearbook" is unique as it is the only publication which gives access to the material of the UNPO, which currently comprises forty-eight members representing over a hundred million people. It will be published annually to provide a permanent record of all the changes and developments relating to UNPO and to the activities of its members.

Review European Public Procurement: Legislative History of the Utilities Directive 2004/ 17 EC / Kluwer Law International:Directive 2004/17/EC governs the rules, provisions, and procedures entailed in public procurement contracts awarded by EU Member States in the water, energy, transport, and postal services sectors. In the course of the eight-year (1996 2004) gestation period of an EC public procurement policy that would meet the challenges of a globalised economy, it became clear that these utilities required a legislative framework distinct from the general coordination of award procedures that finally emerged as Directive 2004/18/EC. This book on the Utilities Directive 2004/17/EC is a companion to an earlier volume on the legislative history of Directive 2004/18/EC. This new volume gathers in one place all the relevant documents that led to the adoption of the Utilities Directive. In great detail this legislative history reveals such crucial elements and outcomes as the following: ports and airports as transport hubs of solid fuels; treatment of relevant WTO Agreements; confidentiality and security; works and service concessions; resale and leasing provisions; competition; communication of technical specifications; tax. environmental, and labour obligations; time limits; and design contests. Introducing the book are excerpts that give a general picture of the reasons that led to the intention to replace the earlier procurement directive for the utilities sectors (93/38/EEC). Then follow excerpts that give an insight into the drafting of the recitals in the Preamble, the articles, and the annexes. The book concludes with a chronological overview of the legislative documents associated with Directive 2004/17/EC and a Keyword Index. Along with its companion volume on Directive 2004/18/EC, this important book will be a powerful resource for lawyers and policymakers engaged in the practice and development of European procurement law. [+]
It will also provide both practitioners and researchers working in the area of European procurement law with an incomparable desktop reference on the Utilities Directive.

Review International Institutional Law: Unity Within Diversity / Brill Academic Publishers:The current decade has been characterized by a resurgence of interest in the law of public international organizations. This fourth, revised edition of International Institutional Law covers the most recent developments in the field. Although public international organizations such as the United Nations, the International Monetary Fund, the World Trade Organization, the European Bank for Reconstruction and Development and the European Union have broadly diverging objectives, powers, fields of activity and numbers of member states, they share a wide variety of institutional problems. In this study, the law of individual organizations is not described separately. Instead the book offers a comparative analysis of the institutional law of international organizations. It includes comparative chapters on the rules and practices concerning, for example, membership, decision-making, financing, legal order, supervision and sanctions, legal status and external relations. The book has been designed to appeal to both academics and practitioners.

Review Ec Anti-Dumping Trade Laws (European Law Series) / John Wiley & Sons:Anti-dumping measures are a means of protection against a form of unfair trade practices, namely, selling goods to the Community at less than their true value. Consequently, EC's anti-dumping regulation (Regulation 384/96) potentially affects almost any class of manufactured goods and has wide reaching implications for companies selling or buying goods within the EC. When dumping does take place, the economic impact of dumping on Community industry and the impact of any anti-dumping measures subsequently adopted against the exporters found to be dumping, may well be as significant as that resulting from a competition investigation. Written by members of the European Commission dealing with the area regulated by the anti-dumping regulation, this text offers additional insight into the subject, particularly since the Regulation 384/96 contains a number of new features to which private practitioners have not yet been able to acquire any practical experience. It provides a detailed commentary on each article of the regulation taken article by article - this commentary is supplemented by an introductory section giving a brief overview of the EC and GATT background with a concluding section dealing with all aspects of judicial review of anti-dumping measures.
