Review Essays in Honour of Wang Tieya / Springer:An account of the life and achievements of Professor Wang Tieya is a chronicle of both an individual and his country. The life of this remarkable figure in international law is closely intertwined with the tumultuous events which have, in the space of this century, transformed China from a dynastic colony into an independent republic and a major world power. That transformation has not been an easy one; and the turmoils of war, civil uprising, and devastating internal purges which marked the growth and development of his country have also marked the life of Professor Wang. This book is dedicated with admiration, esteem, and affectionate good wishes to Professor Wang on the occasion of his eightieth birthday. The more than fifty chapters which the book contains, constitute an impressive and fascinating survey of international law in the last decade of the twentieth century.

Review Gender and Human Rights in Islam and International Law: Equal Before Allah, Unequal Before Man? / Springer:This study offers a conceptual analysis of gender and human rights under Islamic law, state law and international law, and extends this analysis to a specific examination of the nature of women's rights in the Islamic tradition. It explores the disparity between the theoretical perspective on women's rights and its application to Muslim jurisdictions, determined by elements of cultural practices, socio-economic realities and political expediencies, and uses the example of Pakistan to demonstrate the divergence between the theory and practice of Islamic law in these jurisdictions. It discusses the concept of an emerging "operative" Islamic law, which includes principles of Islamic law, secular codes of law and popular custom and usage. Is the notion of human rights a purely "Western" concept? Is there a human rights discourse in Islam? What is the degree of compatibility or otherwise between the concept of human rights in the Islamic tradition and that viewed from an international legal perspective? Are men and women regarded as being equal in the Islamic legal tradition? Does formal equality always translate into substantive equality? This study aims to answer these and many other questions. The author aims to deconstruct the various intractable notions that exist about gender, human rights, Islam and international law. She establishes a methodology for analyzing complex situations encompassing a variety of disciplines and presents a number of alternative approaches for their greater understanding. The book is based on extensive and in-depth research and provides a wealth of information across a number of fields including human rights, Islamic law, gender and the law, international law and constitutional law. It should be useful to academics, lawyers, researchers, activists and policy makers involved in human rights issues, gender studies and Islamic law.

Review Judge Shigeru Oda and the Progressive Development of International Law:Opinions, Declarations, Separate Opinions, Dissents, on the International Court ... Opinions, Dissents on the International Co) / Springer:The present volume is the first in a planned series, "The Judges", which collects and synthesizes the opinions of leading international judges of the contemporary era who have contributed significantly to the progressive development of international law. The series is launched with the judicial opinions of Shigeru Oda, the Vice President of the International Court of Justice. The collection of Opinions covers the period from Judge Oda's first election to the International Court in the Autumn of 1975, on to the year 1992. All of the individual Opinions filed by Judge Oda in this period - Separate Opinions, Declarations and Dissenting Opinions - are included, and they are published in full, without editorial cuts. An introductory essay examines the diverse educational and professional influences contributing to Judge Oda's formation as a jurist, from his earliest university years in Japan and in the United States, through his subsequent professional career in universities and government service and at international academic-scientific and diplomatic reunions over the years. The study includes a resume and analysis of Judge Oda's judicial opinions, through the cases, and attempts some identification and synthesis of the main elements in his approach to decision making and opinion writing, as well as the main strands in his judicial philosophy, as demonstrated in the actual case law.
