Review The Law of Maritime Delimitation: Reflections / Cambridge University Press:The problem of maritime delimitation is one of the most disputed questions in international law. Out of the several hundred situations calling for maritime delimitation, only about a hundred have so far been settled. Numerous negotiations are under way, and several cases will come before international tribunals over the next few years. The purpose of this book is to assess the meaning and scope of the solutions already reached, to submit them to a critical analysis, to identify the directions in which the evolution of the law is headed, and to advance some suggestions as to desirable developments. particularly in the light of the judgment of the International Court of Justice in the Libya/Malta case, Professor Weil argues cogently in favour of equidistance as a starting point, modified as necessary by reference to equitable considerations.

Review Legal Treatment of Foreign Investment:The "World Bank Guidelines" / Springer:On September 21, 1992, the Development Committee, a joint ministerial committee of the Boards of Governors of the World Bank and the International Monetary Fund issued a set of universal guidelines on the legal treatment of foreign investment and called those Guidelines to the attention of the members of these institutions. The text of the guidelines was prepared by a small working group chaired by Ibrahim Shihata, the World Bank's Vice President and General Counsel. According to Mr. Shihata, the success of this endeavour was "the product of changing realities and perceptions about foreign investment and the benefits it can bring to global economy and the economies of developing countries in particular. In a broader sense, the great transformations of the late 80s and early 90s created a new environment which made possible agreement on many issues thought earlier to defy common solutions. " This book provides a record and a personal account of the author of the steps which led to the issue, by the Development Committee, of the Guidelines on the Treatment of Foreign Investment, and a first hand explanation of the text of the Guidelines (which is published in the book in three languages). The book also contains the studies which preceded the preparations of that text and the official reports which explain its rationale and contents. The book may therefore be read as a complement to the author's earlier book on "MIGA and Foreign Investment" (1988). Together, the two books provide detailed accounts of the continued efforts by the World Bank to encourage the flow of international investments through specific mechanisms which complement its financing, catalytic and advisory roles in pursuance of one of its main purposes, which is "to promote foreign private investment. ".

Volume two deals exclusively with jurisdiction and the treatment of jurisdictional matters by the Court, and volume three devotes itself to the court's procedure. Volume four, in addition to indexes, has the English text of the Charter of the United Nations, the Statute of the Court and the 1978 Rules of Court.

Review Capaldo Repertory of Decisions / Springer:The present Repertory presents in `manual' form the case law of the International Court of Justice. It attempts a popularization of the Court's maxims in plain language for easy reading so as to provide not only the internationalists but also practitioners and students with a full and readily consultable digest on a rich and important body of judicial opinions, in the knowledge of the Court's decisive role in ascertaining, noting and developing the rules of international law. The Repertory embodies a corpus of legal maxims synthesized ex novo from decisions of the Court. These rules have been arranged in a systematic order under headings and subheadings and classed in a logical sequence under each heading in order that the reader may proceed from the general to the specific. The present Repertory also contains an extensive section dealing with the procedure of the International Court and the interpretation of the procedural rules contained in its Statute and Rules of Court. A smaller section deals with advisory proceedings serving the object of an appeal.

Review Private International Law: Supplement 2 : Czech Republic / Kluwer Law International:This is the first and only publication to provide comprehensive coverage of national laws on conflict of laws, now more commonly referred to as private international law. It presents country-by-country national monographs dealing with the statutes, regulations and case law each country applies to cases involving transnational issues in, e. g. , business, family or inheritance law. It offers every lawyer dealing with questions of conflicts of laws much-needed access to the conflict rules of other countries, presented clearly and concisely by local experts. The looseleaf format allows the monographs to be kept regularly up to date. Beginning with a general introduction to the private international law of the country concerned, each monograph goes on to discuss choice of law technique, sources of private international law, the relevant connection with the law of a country and the connecting factors, the rules of choice of law on natural and legal persons, contractual and non-contractual obligations, movable and immovable property, intangible property rights, company law, family law, marriage, cohabitation, registered partnerships, property, maintenance, child law, and succession law, including testamentary dispositions. Each national monograph concludes with an overview of the country's relevant civil procedure, examining lex fori and issues of national and international jurisdiction, acceptability and enforcement of foreign judgements, and international arbitration. This subset of the International Encyclopaedia of Laws is an excellent guide for lawyers, judges, legal counsel, notaries public, marriage registrars, youth welfare officers, and local public authorities, as well as teachers, students, and legal researchers.

Review Liber Amicorum Judge Shigeru Oda / Springer:Judge Shigeru Oda, having served since 1976 in three successive nine-year terms on the International Court of Justice, has helped to shape the Court's jurisprudence for over a quarter century. His influence on the law of the sea spans an even longer period, beginning with his doctoral dissertation at Yale Law school in the 1950s and continuing with his involvement in the First, Second and Third UN Conferences on the Law of the Sea. In a tribute to Judge Oda's significant contributions to international law, leading scholars on the law of the sea, international dispute settlement and the ICJ itself have produced a Festschrift in his honour. This two-volume work, containing over 95 articles, begins by examining the role of the international judge and the jurisdiction of international tribunals (including reservations to jurisdiction, the Optional Clause, the Special Agreement, and the power to indicate special measures). It contains a particularly lively debate regarding the proliferation of international tribunals and whether the potential for conflicting decisions is problematic or productive. Other areas of focus include the history and development of the law of the sea; the first in-depth examination of the establishment and first decisions of the International Tribunal for the Law of the Sea; and the ICJ's treatment of the development, doctrines and sources of international law. Further sections are devoted to international litigation as analysed by leading practitioners; land and maritime boundaries, international watercourses and other waters; and defence, the use of force and the law of armed conflict.

Review International Encyclopedia of Laws - Intergovernmental Organizations (International Encyclopaedia of Laws) / Kluwer Law International:The world is getting smaller and increasingly interdependent every day. As a result, national and regional developments are, as a matter of necessity, seen in a global framework. States want to preserve their independence but they are confronted with a growing list of problems which they can only solve in cooperation with others. The sheer scale of the issues at stake calls for an institutional framework to give that cooperation a more permanent structure. Hence, decisions taken at the national level and results of intergovernmental cooperation have become closely intertwined. It is, therefore, appropriate in the framework of the International Encyclopaedia of Laws to make accessible comprehensive, substantial and readily available information on the most important IGOs, given their importance for the development of international law and intergovernmental co-operation at large. The fundamental changes taking place nowadays at an incredible pace within IGOs render it all the more necessary to put this information within easy reach. Some 50 leading organizations are described in separate monographs of approx. 100 pages each.
