Review The Peaceful Settlement of International Disputes in Europe:Future Prospects: Colloque, 1990 - Workshop 1990 (Recueil Des Cours - Colloques/Workshops/ Law Books of the Ac) / Springer:

Any dreams that Europe had at last become too mature a society of states for the continent to be afflicted by bloody international disputes have been shattered in recent months. This book examines both the sources of disputes - the delimitation of boundaries, ethnic differences, human rights violations, environmental damage, drug control, etc. - and the most appropriate methods for settling them. Many of the contributors have played major roles in devising and operating dispute settlement procedures. This bilingual (English and French) volume is designed to serve as a "vade-mecum" for diplomats and officials, and a reference work for students, academics, and all those interested in international law and relations.

Review Collection of Icc Arbitral Awards 1986-1990 (Collection of ICC Arbitral Awards Series Set) / Kluwer Law International:

This second volume of the Collection of ICC Arbitral Awards contains the awards that have already been published between 1985 and 1990 in the Yearbook Commercial Arbitration, the Journal du Droit International (Clunet) and also in the International Construction Law Review. Like in the past volume (1974-1985) certain awards are produced both in English and French. The Analytical Table of Volume II covers all the awards contained in both Volumes I and II. The publication also includes a Consolidated Analytical Table, a Chronological Index and a Table of Cross-Referenced Tables. This book is an invaluable reference for anyone who wants to be informed about the ICC arbitration procedure and the awards made applying the different laws of a variety of trading nations. It is equally useful to the practitioner involved in drafting, negotiating and resolving international commercial contracts as it is to the scholar seeking source material on today's trends in international private and commercial law.

Review The Authority of the Security Council under Chapter VII of the UN Charter:Legal Limits and the Role of the International Court of Justice (Studies and ... Settlement of International Disputes, V. 8) / Springer:

This volume discusses the legal limits to the authority of the Security Council under Chapter VII of the United Nations Charter. The interest in this topic regained importance when the Security Council started to play an increasingly active role after a period of dormancy between 1945 and 1990. The work describes various approaches to Charter interpretation, provides an overview of the Council's powers under the Charter and surveys the Council's recent practice with regard to the maintenance of international peace and security. Subsequently the sources and contents of the limits to the Council's authority are analyzed. This is followed by an analysis of the role of the International Court of Justice, which includes an overview of the main obstacles to, and possibilities of, judicial review by the Court of Council decisions taken under Chapter VII. Finally, the work discusses recent proposals to enhance the Council's legitimacy.

Review Exclusion from Participation in International Organizations:The Law and Practice Behind Member States' Expulsion and Suspension of Membership (Studies ... Settlement of International Disputes, V. 5) / Springer:

This volume deals with expulsion from and suspension of membership rights in international organisations. This is an area of the law of international organisations which has attracted limited attention by academic writers. The book examines some 35 different international organisations by analysing the relevant provisions in their constitutive instruments and, where available, discussing the practice. Additionally, it describes in considerable detail the practice of rejecting delegations' credentials as a means of excluding Member States from participation. Moreover, it suggests solutions for those international organisations lacking expulsion and/or suspension clauses by applying the Vienna Convention on the Law of Treaties and the theory of countermeasures in international law, especially as codified by the International Law Commission. Finally, the book offers a model expulsion and suspension clause to be incorporated in existing or future international organisations.

Review Diplomacy on the Jordan: International Conflict and Negotiated Resolution (Natural Resource Management and Policy) / Springer:

The Jordan River waters are essential for the development and well being of the people of its basin. Plans for the development of its water resources were considered since the beginning of the twentieth century, and have long been central to dispute between riparian nations. This volume reviews the roots of conflict over the Jordan between Arabs and Jews and the development of that conflict over the past 150 years. It analyzes the positions of Arabs and Israelis and the role of the United States in promoting a settlement. The work then presents the development of a negotiated resolution of that part of the conflict related to Jordan and Israel through the Middle East Peace Process. This book approaches the Jordanian-Israeli water affairs in the Jordan River Basin with a wide interdisciplinary perspective. It unfolds the full history of the dispute and negotiation process, beginning in the 1950s and ending with the water accord in 1974.

Review The Settlement of Foreign Investment Disputes / Kluwer Law International:

Disputes arising from foreign investment activities are on the increase, and with them a growing awareness among practitioners of a greater variety of settlement methods than most legal analyses have dealt with heretofore. With the experience gained in recent years from a broad spectrum of successful negotiation, arbitration, and litigation techniques, it is possible to derive a comprehensive, critical survey of the principal methods of settling foreign investment disputes. This outstanding book masterfully provides such a survey. The Settlement of Foreign Investment Disputes in International Law treats the subject systematically, dealing first with the internal balances within modern foreign investment contracts, the complexities that arise due to state participation or interference in these contracts, and the stances that are taken when disputes arise. It goes on to examine, in turn, the main issues involved in negotiation, arbitration, and judicial settlement as the methods of settling foreign investment disputes, discussing the controversial themes in each of these methods in detail. Recognizing that the focus of attention is shifting to the misconduct of multinational corporations, the last chapter contains a discussion of the role of domestic courts.

Review The Uncitral Arbitration Rules in Practice, the Experience of The / Kluwer Law International:

This publication is a concise and colourful presentation of the authors' first-hand experience with the remarkable, stormy procedural history of the Iran-U. S. Claims Tribunal in The Hague. Examining each rule in turn, the authors examine the first intent of the UNCITRAL framers, as evident from the travaux preparatoires, and then analyze how the Rules were interpreted, changed and applied at the tribunal. <p class=copymedium>This volume is destined to become a standard reference on the procedural aspects of international commercial arbitration. Parties involved in arbitration, their counsel, and others interested in international practice will treasure this explication of the pitfalls and ambiguities in the real-life application of the Rules, including the role of international political intrigue, in the highly charged atmosphere of multinational proceedings.

Review The OSCE in the Maintenance of Peace and Security:Conflict Prevention, Crisis Management and Peaceful Settlement of Disputes / Springer:

This book illustrates the OSCE institutional system and critically evaluates its ability to cope with an evolving European security order. It extensively covers the three-fold core of the OSCE: human rights, peaceful settlement of disputes, and peace-keeping. In doing so, it includes discussion of the High Commissioner of National Minorities, long-term missions, peace-keeping instruments and OSCE relations with the United Nations and European security organizations, the Valletta mechanism, and the OSCE Court of Conciliation and Arbitration. The OSCE in the Maintenance of Peace and Security benefits from diverse perspectives via the efforts of lawyers, career diplomats, international relations scholars, and international officials. Its extensive index facilitates consultation on a broad range of complex issues including the practice of the Organization, with an analysis of case-studies such as Nagorno-Karabakh and the former Yugoslavia; the theoretical foundation of OSCE instruments and functions; and a chapter on OSCE's Mediterranean dimension, examining the OSCE periphery and the possibility of its geographical expansion. The OSCE in the Maintenance of Peace and Security's complete account of the OSCE structure, functions, and perspectives makes it an invaluable tool for lawyers, international relations experts, diplomats, and international civil servants.

Review Considerations of Equity in the Settlement of Territorial and Boundary Disputes (International Law in Japanese Perspective, Vol 2) / Springer:

An increasing reference to equity can be seen in recent international treaties, despite the general and sustainable, criticism of its application to the legal relations between states on the grounds of its subjectivity. Be that as it may, States tend to insert equitable provisions in treaties, either in the preamble or in the operative clauses, particularly those dealing with dispute settlement. This is a direct reflection of the States' awareness of the need for a practical response to changes or new developments in international relations which cause or may cause gaps in the existing rules of international law. There are many unresolved territorial and boundary disputes in the world today and Japan has its share of them. Logically, all such disputes require settlement, but experience shows that they tend to remain unsettled unless some urgent impulse is given, such as the need to explore or exploit hydrocarbon resources in the disputed area. Recent international arbitral and judicial decisions in this area seem to be based on an equitable solution based on the consideration of the relevant circumstances. The fact that this study is included in the "International Law in Japanese Perspective" series does not mean that it offers practical solutions for the many Japanese territorial disputes, rather, it is an analytical study of equitable considerations in past cases of territorial and boundary dispute settlement. A careful reader, however, should detect what may be called a Japanese perspective in the manner in which the arbitrations are analyzed, and in the discussion of the theoretical aspects in Chapters III and IV. "International Law in Japanese Perspective" is a series which provides an insight into the latest developments in Japan's attitude towards international law and practice. The series contains works on Japan's contribution to and position in international law, as well as works by Japanese scholars on general questions of international law.

Review Third Party Dispute Settlement in an Interdependent World:Developing a Theoretical Framework (Developments in International Law, Vol 19) / Springer:

The central theme of this book is the strengthening of the legitimacy and integrity of international law in the post-Cold War, interdependent international community. The investigation focuses on the relationship between international decision-making procedures, in particular compulsory third party dispute settlement, and legitimacy and integrity as perceived by states and other international actors. It starts with a description of recent developments with regard to dispute settlement in the law of the sea, GATT/WTO, Antarctica, and global environmental protection. Compulsory third-party dispute settlement has been accepted in treaty regimes in these fields as it is indispensable in safeguarding the legitimacy and integrity of such regimes. The focus then shifts to an extensive analysis of changes in the international community in general, and their consequences for the international legal system. By focusing on legitimacy and integrity, and by providing a theoretical framework in which these concepts can be applied, this book contributes significantly to the discussion of the theoretical foundations of international law. The author is winner of the 1995 Award of the Foundation Praemium Erasmianum, Amsterdam.
